FEMA -- the most powerful entity in the United States -- was not created under Constitutional law by Congress. Presidential Executive Orders Created It. FEMA's enormous powers can be triggered easily. In any form of domestic or foreign problem ("real" or politically "manufactured") emergency powers can be enacted. US President George W. Bush now has BROADER POWERS TO DECLARE MARTIAL LAW and activate FEMA's extraordinary powers. Under emergency plans already in existence, the power exists to suspend the Constitution and turn over the reigns of government to FEMA, who appoints military commanders to run state and local governments. FEMA then would have the right to order the detention of anyone whom there is reasonable ground to believe will engage in (or probably conspire with others to engage in) acts of espionage or sabotage. The plan authorizes the establishment of concentration camps for detaining the accused -- but no trial. Specialist Baker, 37, is an American.., an Air Force veteran.., member of the Kentucky National Guard.., served in the first gulf war and...as a military policeman at Guantánamo Bay... In January 2003, a Guantanamo officer asked him to pretend to be a prisoner in a training drill.., put on an orange prison jumpsuit over his uniform, and [crawl] under a bunk in a cell so an "internal reaction force" could practice extracting an uncooperative inmate. The five US soldiers [involved] were told he was a genuine detainee and had...assaulted a sergeant. "They grabbed my arms, my legs.., and got up on my back...while I was face down. Then...reached around and began to choke me and press my head down against the steel floor... When I couldn't breathe...I gave the code word...to stop the exercise -- RED... That individual slammed my head against the floor and continued to choke me. Somehow...I muttered...`I'm a U.S. soldier"... Then the soldiers noticed that he was wearing a US uniform under the jumpsuit... Mr. Baker was taken to a military hospital for treatment of his head injuries, then flown to a Navy hospital... But Mr. Baker began suffering seizures, so the military sent him to the Walter Reed...for treatment of a traumatic brain injury. He stayed at the hospital for 48 days...and was finally given a medical discharge... Meanwhile, a military investigation concluded that there had been no misconduct involved in Mr. Baker's injury...[and] says it can't find a videotape...believed to have been made of the incident. Most appalling, when Mr. Baker told his story...the military lied...to undermine his credibility. Maj. Laurie Arellano...told reporters his medical discharge was unrelated to the injuries he had suffered... In fact...the Physical Evaluation Board...stated..: "The TBI [Traumatic Brain Injury] was due to soldier playing role of detainee who was non-cooperative and being extracted from detention cell in Guantanamo Bay...during a training exercise."
